TERMS OF SERVICE

By booking a photo or video shoot, the Client fully agrees to all the terms and conditions set forth below.

1. Communication & Agreements

  • 1.1. All discussions regarding the details of the shoot (technical specifications, creative briefs, concepts, and references) must be conducted in writing via email or messengers.
  • 1.2. If any details are discussed via phone or in person, all agreed-upon terms must be subsequently confirmed in writing.
  • 1.3. Written agreements shall strictly take precedence over verbal communication.

2. Copyright & Usage Rights

  • 2.1. The copyright to all created photo and video materials permanently belongs to the Contractor.
  • 2.2. The Client consents to the use of their images/videos in the Contractor’s professional portfolio, social media channels, contests, exhibitions, publications, and promotional materials.
  • 2.3. If the Client objects to the publication of the materials, they must notify the Contractor in writing prior to the shoot. No additional fee is required for non-disclosure.
  • 2.4. The transfer of raw files (RAW/Log) does not imply a transfer of copyright.
  • 2.5. Source files and processed materials shall not be disclosed to third parties without the Client’s explicit consent.

3. Booking, Rescheduling & Cancellation

  • 3.1. Upon booking confirmation, the Client secures the date/time slot and receives full concept consultation, location scouting recommendations, and preparation checklists.
  • 3.2. In the event of a cancellation by the Client, the deposit (date reservation fee) is non-refundable.
  • 3.3. Rescheduling is permitted no later than 3 days prior to the shoot date and is allowed only once, subject to the Contractor’s current availability.
  • 3.4. Studio rental cancellation fees are governed strictly by the specific studio’s policies and must be resolved with the studio administration directly.
  • 3.5. In the event of force majeure (illness, severe weather conditions, unexpected technical malfunctions), both parties shall agree to reschedule the shoot to the earliest available date.
  • 3.6. The Contractor reserves the right to cancel the session immediately in the event of a material breach of these terms by the Client.

4. Payment Terms

  • 4.1. The remaining balance is due immediately upon completion of the shoot on the same day.
  • 4.2. The production turnaround timeline officially begins only after the service is paid for in full.

5. Production Turnaround & Deadlines

  • 5.1. Final photo delivery takes 7 to 14 calendar days, unless a priority delivery timeline is specified in the selected service package.
  • 5.2. Final video delivery takes 7 to 21 calendar days, unless a priority delivery timeline is specified in the selected service package.
  • 5.3. If the Client delays the selection of images for final retouching by more than 7 days, the delivery deadline will be automatically extended.
  • 5.4. All source materials and final files are archived by the Contractor for 1 month after delivery. Long-term storage is not guaranteed after this period.

6. Formats & RAW Files

  • 6.1. If the Client requires unedited source materials in JPEG format, this request must be specified in writing prior to the session.
  • 6.2. Unedited RAW files are provided upon request for an additional fee equal to 50% of the total session cost.

7. Revisions & Creative Style

  • 7.1. The package price includes up to two rounds of minor adjustments within the scope of the pre-approved creative brief.
  • 7.2. Any additional rounds of revisions or changes outside the original brief will be billed separately at the Contractor’s hourly rate.
  • 7.3. Post-production revisions are strictly confined to the pre-agreed scope of work. Changes to the core concept, narrative structure, format, or duration after filming has concluded constitute a new assignment and will be invoiced separately.
  • 7.4. By booking the Contractor, the Client fully confirms their familiarity and agreement with the photographer’s signature shooting and editing style.
  • 7.5. Subjective evaluations of the final result (“I don’t like the style, ” “I expected something else”) do not constitute grounds for revisions or refunds.

8. Liability & Dispute Resolution

  • 8.1. The service i legally considered fully rendered once the shoot is  completed and the finished and/or raw materials are delivered via the online gallery link.
  • 8.2.  full or partial refund is only possible if the service was failed to be rendered solely due to  the Contractor’s fault.
  • 8.3. The Contractor i not liable for the Client’s physical appearance, wardrobe malfunctions, or the quality of work performed by third-party makeup artists and stylists engaged by  the Client.
  • 8.4. I the Client arrives late, the shooting duration will not be extended, and the lost time will not be  compensated.
  • 8.5. I the absence of specific, objective, and quantifiable technical non-compliance with the written brief, the service is deemed to  have been executed properly.

9. Commercial & Business Photography Terms (B2B)

  • 9.1. Upon receipt o full payment, the corporate Client is granted a non-exclusive, worldwide, perpetual commercial license to  use the materials for PR, marketing, and advertising purposes.
  • 9.2. The sub-licensing o transfer of materials to third-party partners or marketing agencies is fully permitted within the scope of  the Customer’s standard business operations.
  • 9.3. The full transfer o exclusive copyright must be formalized via a  separate, explicit written agreement.
  • 9.4. The Client warrants that they hold all necessary intellectual property rights for any logos, trademarks, products, o  music tracks provided for the shoot.
  • 9.5. The Client i solely responsible for obtaining any necessary commercial filming permits or  location releases for the chosen venues.
  • 9.6. The Contractor bears n legal liability for any consequences arising from how the Client chooses to publish or  utilize the final materials.

10. Return & Refund Policy

  • 10.1. N full or  partial refunds are provided after the production phase has concluded and the materials have been made available for download.
  • 10.2. Subjective visual preferences d  not constitute grounds for financial compensation.
